Daria Kim is a Managing Director in the FTI Forensic and Litigation Consulting Segment and is based in New York. Ms. Kim specializes in the application of finance, economics and accounting to problems in complex business litigation primarily relating to intellectual property. Prior to joining FTI, Ms. Kim was a Manager in the IP litigation consulting practice at Hoffman Alvary & Company in Boston. In non-litigation matters, Ms. Kim has advised clients on strategy, operations, and organization to increase performance and productivity across various business lines.

Ms. Kim has managed cases arising out of general intellectual property disputes such as patent infringement, trademark infringement, copyright infringement, and misappropriation of trade secret. In connection with these matters, Ms. Kim has conducted complex damages analysis involving lost sales, lost profits, disgorgement of profits, price erosion, reasonable royalty, and unjust enrichment, among others. She has evaluated and analyzed plaintiff’s and defendant’s market size and ability to achieve sales, revenue sources and trends, convoyed sales, overall company and product profitability, and production and distribution capacity, as examples. She is experienced in the application of the Panduit factors, the Georgia-Pacific factors, and other case law to the determination of damages and has reviewed hundreds of license agreements for reasonable royalty determinations.

In addition, Ms. Kim has provided assistance to counsel in all phases of the litigation process from document discovery and case strategy to expert report, deposition, and trial preparation. Her casework also includes the assessment of damages in a variety of non-intellectual property business disputes such as false advertising and breach of contract. Her case experience spans multiple industries, including: medical devices, food products, automotive, pharmaceuticals, semiconductors, software, biotechnology, and telecommunications, among others.

Ms. Kim holds an M.B.A. from the M.I.T. Sloan School of Management. She also holds a B.A. from the University of Virginia.
