The FTI Intellectual Property group has a deep breadth of experience in intellectual property matters in the Automotive industry. Representative intellectual property engagements are described below:
Assisted a manufacturer of platinum tip spark plugs by calculating lost profits, price erosion and reasonable royalties in a patent infringement litigation.
Retained in matter involving alleged infringement of method patents addressing radio frequency devices used in automobile vehicle electronic remote entry and security systems as manufactured by first tier automotive manufacturer supplies.
Assisted plaintiffs in patent infringement suit involving motor vehicle transmission differentials. Issued involved included lost profits on lost sales, reasonable royalties, price erosion and lost profits on convoyed sales.
Valued a portfolio of trademarks owned by a manufacturer and distributor of tires and other rubber and chemical products.
Engaged by a large automobile manufacturer to assist in the establishment of an intellectual property holding company (“IPHC”). Services included the valuation of over 5,000 patents for transfer from the parent company to a subsidiary that was being divested and implementation assistance for process development and “operationalizing” the IPHC. This assistance took the form of checklists, milestones, and issues, which were written, outlined, and documented to ensure that the new company accounted for the key factors involved in intellectual property management.
Counsel for a manufacturer of an automobile security system retained FTI to analyze economic damages, if any, related to alleged patent infringement for certain components of its products. A detailed analysis of the market for car alarms was performed and a royalty rate was established for the technology at issue.
Retained by amanufacturer of GPS devices for the automotive industry to determine damages in connection with a patent infringement matter. Analyses performed included market segmentation, customer level purchasing patterns, and geographic sales analyses.
For a diversified automotive industry parts supplier, developed estimate of economic damages arising from infringement of method for manufacturing electrodes for a spark plug . Analysis focused on definition of relevant markets, manufacturing efficiencies, customer acceptance, profits margins and the entitlement to various forms of damages in each market. Developed estimate of lost profits, reasonable royalty and past/future price erosion forms of damages. Conducted hypothetical negotiations to determine reasonable royalty rate.
Conducted a review of joint business operations on behalf of a corporation that provided critical enabling technology to one of world’s largest automotive suppliers. The joint business arrangements called for royalties to be paid to the technology provider based on net profits. A review of the business operations and profit sharing calculations identified multiple issues related to cost allocations, transfer pricing and contract compliance.
Engaged by defense counsel representing a manufacturer of power converters used in the recreational vehicle industry. Provided analysis of lost profits and reasonable royalty.
Retained by a major auto parts manufacturer in its defense of patent infringement claims related to the manufacture and sale of catalytic converters. The analysis included a review and assessment of the Plaintiff’s lost profits claim including an analysis of the Plaintiff’s alleged lost sales, cost and profits. Additionally, the analysis involved a determination of a reasonable royalty.
Assist the Plaintiff, an automobile manufacturer in a trademark infringement matter involving the Defendant’s use of the Plaintiff’s mark on various automotive accessories. Analysis included a review of the Defendant’s products at issue, marketing channels, similarity of the marks and an assessment of the Defendant’s profits on sales of the products at issue.
