The FTI Intellectual Property group has a deep breadth of experience in intellectual property matters in the Business industry. Representative intellectual property engagements are described below:
For a multination industrial products manufacturer, evaluated damages in a patent infringement, unfair competition and theft of trade secrets matter dealing with on-press imaging equipment in the printing press industry. At issue was the alleged patent infringement and theft of trade arising from a product development and supply agreement. Analyzed harm by theft of trade secrets, disgorgement measures of damages and reasonable royalty measures of damages.
One of the world’s largest bottling and distribution operations purchased several dozen additional bottlers during a short period of time. The large bottler expended several billion dollars to accomplish these purchases. Our team analyzed the operations and financial performance of the various target bottlers and assisted the purchaser in assigning values to the target bottlers for tax litigation purposes. In addition we valued the rights to the trade names and trademarks purchased as part of the transactions. These trade names and trademarks were valued, among other methods, by analyzing the effects in various marketplaces of the trade names and trademarks on increased consumer demand and on the ability to achieve a premium price for these products.
Managed a project for a well-known soft drink company that was responding to a multi-billion dollar IRS challenge over the treatment of certain intangible assets including the Company’s trade names and marks. This project involved the study of the transfer of intangibles from the company to its foreign and domestic bottlers. The team inventoried and valued all major intangibles of this Fortune 100 Company in this multi-billion dollar dispute.
The tax litigation was settled favorably to our client.
A $4 billion corporate plaintiff asked us to construct a damages claim related to alleged breach of contract, patent infringement and theft of trade secrets in the hospitality industry. Our team assisted counsel in structuring and analyzing the damages claim approached $100 million by interviewing client personnel, analyzing case documents, constructing a model to determine economic losses, and assisting in the deposition process. The case resulted in a settlement favorable to the client company.
Analyzed trademark infringement claims for a national firm in the data management industry.
Engaged by plaintiff's counsel representing a robotics manufacturer involved in a trade secret dispute. The matter involved allegations that a foreign company had obtained trade secrets of the robotics manufacturer through the hiring of a former employee. Analysis included lost profits and unjust enrichment and was instrumental in reaching a favorable settlement for the plaintiff in this matter.
Led a team domestically and abroad to perform royalty audit of a major license agreement between a
U.S.
company and its licensee located in the
Philippines
. Work involved analysis and review of the books and records of the licensee and preparation of a report of our findings.
