As part of the trial monitoring process, FTI litigation advisors employ a team of shadow jurors – or a mirror jury – comprising four to eight mock jurors who match the demographic characteristics of the jury in such areas as gender, age and education. The shadow jurors attend trial and are interviewed daily about their reactions to testimony and arguments. Mirror juries are useful if the attorneys are engaged in serious behind-the-scenes settlement negotiations concurrently with the trial, or if the attorneys are still deciding whether or not to offer testimony by a witness with positive and potentially damaging information. In either instance, trial monitoring affords the trial team a day-to-day assessment of juror reactions.
In addition, FTI provides the trial team with oral feedback of the shadow jurors' perceptions each evening during trial as well as provides a written summary the next day.
