Jayson S. Dukes is a Senior Managing Director at FTI Consulting and is based in New York City. Mr. Dukes has provided dispute advisory and forensic accounting services to attorneys and corporate clients for more than 29 years with a focus on the life sciences and healthcare industries. Mr. Dukes has advised clients on a variety of governmental regulatory compliance issues, including matters concerning Medicare, Medicaid, and other government payer reimbursement. He also has assisted in negotiating resolutions with many government agencies, including the Department of Justice, United States Attorney’s Office, Center for Medicare and Medicaid Services and the Office of Inspector General.
In the life sciences industry, Mr. Dukes has helped clients address government investigations and congressional and regulatory inquiries. He has worked extensively with pharmaceutical manufacturers concerning price reporting issues as well as their promotional practices.
Mr. Dukes is currently serving or served as the Independent Review Organization (“IRO”) for three major pharmaceutical manufacturers to satisfy requirements of a Corporate Integrity Agreement (“CIA”) the manufacturers entered into with the Office of Inspector General as a part of a settlement related to a government investigation. The IRO’s scope of work includes performing a review of promotional activities, medical affairs, and government price reporting.
Mr. Dukes also has experience as the Compliance Expert for a major pharmaceutical manufacturer to satisfy requirements of a CIA the manufacturer entered into with the OIG as a part of a settlement related to a government investigation. The Compliance Expert is required annually to perform a Compliance Program Effectiveness Review as outlined in the Company’s CIA.
In the healthcare industry, Mr. Dukes has helped providers address qui tam lawsuits, criminal false claims allegations, matters involving medical necessity concerns, regulatory compliance investigations and other matters. He assisted a large health care system and its general counsel with a whistleblower suit filed against the client alleging Medicare/Medicaid billing fraud related to cost reporting. He worked closely with general counsel as well as multiple outside counsel assigned to assist in the discovery phase and with counsel to develop strategies to defend the claim and assisted in settlement negotiation meetings with various governmental agencies.
