Adrian Smith is a Managing Director at FTI Consulting. He is a member of the Economic and Financial Consulting practice, and is based in London.
Adrian is a chartered accountant and has 21 years’ experience of financial analysis relating to international arbitration, civil and criminal litigation, mediation, business interruption claims, business valuation, asset tracing, and regulatory matters. He has provided advice to clients and their legal teams in Austria, France, Italy, Malaysia, Poland, Qatar, Saudi Arabia, the United Kingdom and the United States.
Adrian has prepared expert and other reports, including in matters before the High Court (Chancery Division, Queen’s Bench Division, the Technology and Construction Court and the Administrative Court); the Upper Tribunal, the Amsterdam Court of Appeal (Enterprise Chamber); the Court of Milan; the New Jersey State Court; the Stockholm Chamber of Commerce, ICC and LCIA arbitration forums; and the Financial Conduct Authority’s Regulatory Decisions Committee (RDC).
Adrian has given oral evidence before the High Court and the RDC.
Adrian’s practice focuses on expert financial advice in the context of complex, high-value disputes. Typically, this involves the quantification of lost profits, including business interruption insurance claims; the assessment of breach of warranty or wasted costs claims; or the provision of advice relating to accounting matters or business valuation, including in the context of pensions-related regulatory litigation
In the context of a Judicial Review, Adrian provided a report regarding the adequacy, consistency and sufficiency of financial information published by a UK regulator during a consultation process. The High Court ruled in favour of Adrian’s client that the regulator’s consultation was not transparent and was therefore unlawful.
Adrian has been appointed by the Financial Conduct Authority (formerly the Financial Services Authority) as an investigator under the Financial Services and Markets Act 2000 and has also undertaken regulatory financial investigations for agents of the Treasury Solicitor and the UK government’s Department for Business, Innovation and Skills.
Adrian began his career within Touche Ross & Co / Deloitte Touche Tohmatsu (now branded Deloitte) auditing large, international companies. He was a member of the management consulting team that advised the government regarding privatisation of the UK’s regional electricity companies and the liquidation team following the collapse of the Bank of Credit and Commerce International SA.
Adrian is a chartered accountant and a fellow of the Institute of Chartered Accountants in England and Wales. He is a practising associate of The Academy of Experts.
