Brett Barlag is a Senior Managing Director in the Health Solutions practice of FTI Consulting and is based in Washington D.C. Mr. Barlag helps healthcare organizations address regulatory investigations, qui tam actions, and complex industry litigation; assess and strengthen their regulatory compliance infrastructures; identify, implement, and measure regulatory process improvements; and navigate the impact of regulatory changes on their businesses. Mr. Barlag’s clients and related parties include hospitals; post-acute care providers; pharmaceutical and medical device companies; pharmacies; distributors; and their counsel.
Mr. Barlag has helped organizations across the healthcare continuum address a number of different regulatory issues, especially those relating to alleged non-compliance with federal and state regulations, and overbilling of government programs including Medicare and Medicaid. Mr. Barlag’s experience includes examining and advising clients on regulatory issues stemming from alleged improper pricing and price reporting activities; violations of the Anti-Kickback statute; non-compliance with clinical documentation standards; provision of medically unnecessary services; billing for services not rendered; non-compliance with boards of pharmacy regulations; and non-compliant promotional programs. Mr. Barlag has also helped healthcare organizations address these types of regulatory issues by working with clients to strengthen their regulatory compliance infrastructure. Mr. Barlag has helped organizations develop their compliance programs. He has assessed the effectiveness of compliance programs in identifying, addressing, reporting, and mitigating regulatory non-compliance risks. He has helped organizations develop, implement, and test their policies, procedures, and processes for compliance with government program requirements; and he has recommended and implemented organizational changes to reduce the risk of non-compliance. Mr. Barlag’s compliance expertise has been developed both in the capacity as a direct advisor to clients and their management teams, and as an Independent Review Organization under a Corporate Integrity Agreement.
In many of these matters, Mr. Barlag and his teams utilize clients’ structured enterprise data, as well as relevant industry data, to develop business analytics that shape organizational decision making and focus organizational improvements. These analytics include scenario models that examine the financial impact of Medicare and Medicaid reimbursement issues and regulations; exploratory data and statistical analyses that surface potential billing, pricing, or utilization outliers; internal and external benchmarking data models that look to identify potential performance gaps and measure the effectiveness of changes implemented to address those gaps; and advanced data analytics and other technology solutions.
Mr. Barlag’s professional experience also includes serving as the Chief Financial Officer of a diversified healthcare services company providing clinical staffing, homecare, immunization, and wellness services nationwide.
Mr. Barlag holds his B.A. from the University of Notre Dame and his M.B.A. from Columbia University.
