Brian Blonder is a Managing Director at FTI Consulting and is based in Washington, D.C. where he leads the Intellectual Property (“IP”) Group, Valuation and Damages practices. Mr. Blonder has consulted on numerous engagements since his financial consulting career began in 1985, and his focus on these engagements has been on the determination of damages in disputed matters (often involving IP), or valuation of businesses and/or IP and other intangible assets, for a variety of purposes.
Mr. Blonder’s expert witness consulting and testimony experience includes matters involving infringement, misappropriation, breach of contract, business interruption and tortuous interference, franchisor/franchisee relationships, unfair competition, breach of good faith, fraud and misrepresentation as well as issues in the International Trade Commission such as public interest, domestic industry and remedy. Analysis he has addressed included determination of harm elements including lost profits, reasonable royalties, unjust enrichment, price erosion, irreparable harm and other damages estimation, analysis of financial performance and comparison of performance to peers, review of financial condition, determination of economic viability or unreasonable economic burden, application of cost accounting methodologies, consideration of historical business transactions and application of quantitative and statistical analysis.
Mr. Blonder has valued a variety of businesses and also valued IP and other intangible assets including patents, trademarks, trade secrets, copyrights, internally developed software, non-compete agreements, non-solicit agreements, customer lists and customer relationships, acquired favorable contracts, workforce, rights to use, and goodwill. Mr. Blonder has also addressed valuation of businesses and/or assets as a strategic consultant or in troubled company and/or bankruptcy matters.
Mr. Blonder has provided testimony addressing damages and the impact of transactions, events or actions on the performance of businesses through reports, deposition and trial testimony in several different court jurisdictions. Mr. Blonder has been recognized as an expert on damages and harm in federal and state courts.
Mr. Blonder has provided litigation and valuation consulting services in many industries, including automotive and truck (OEM’s, financing entities, dealerships, suppliers); computers (hardware, components, software and peripherals); health care, medical products and supplies, pharmaceuticals and biotech; chemicals; Internet (including e-commerce); telecommunications (including wireless, cable and satellite); industrial products; retail; and electronics.
Mr. Blonder has authored articles and addressed numerous professional groups on a variety of topics, including damages in litigation matters, intangible asset valuation, financial due diligence in mergers and acquisitions, valuation of IP in bankruptcy matters, intangible asset metrics, managing IP, and the application of discount and interest rates to damages.
Prior to joining FTI Consulting, Mr. Blonder was a Partner in the Financial Advisory Services (FAS) practice at PricewaterhouseCoopers. His career also includes full time work as a Managing Director at an IP consulting firm, a Budget Analyst at a military facility and as a computer systems designer.
