With the Digital Markets Act (“DMA”) coming into force, intended to promote fair competition and foster innovation in the digital economy, a new standard for digital market regulations was set. With key obligations and requirements on companies designated as a Gatekeeper for core platform services (“CPS”) by the European Commission (“EC”), non-compliance could result in a sanction of up to 10% of the company’s total worldwide annual turnover. With potentially with billions at stake, as well as significant reputational damage, a technology company needed validation for its regulatory return statements and looked to FTI Consulting for support in navigating this newly transformed regulatory landscape.
- FTI Consulting helped the client navigate this high-profile and first-of-its kind regulatory challenge, delivering an in-depth report validating the firm’s regulatory return statements, mapping over 120 pieces of evidence to nearly 300 individual requirements.

Our Role
- FTI Consulting issued an initial Request for Information that aligned with the DMA Report Template published by the EC.
- Our experts organized interviews with several of the client’s subject matter experts to explicitly discuss profiling techniques and enhance understanding for the response validation.
- After conducting extensive interviews, numerous information exchanges and robust external testing routines, FTI Consulting presented an initial findings draft to the client, clarifying identified gaps and ensuring accuracy.
- After a final sequence of tests and validation, the conclusive DMA report was issued, with the client’s compliance confirmed.
