When millions of customers’ funds were frozen during the COVID-19 pandemic, federal regulators ordered a global financial institution to investigate and remediate a surge of customer claims. FTI Consulting was engaged to independently design and administer an individualized review process to ensure compliance and identify harmed consumers for redress.

Addressing Compliance Gaps at an African Telecom Facing National Scrutiny
A state-owned telecom provider in Africa faced allegations of corruption in its procurement practices that exploded into national press headlines. The company’s board of directors engaged FTI Consulting to conduct an independent review of its procurement practices to evaluate whether vendor selection and procurement procedures aligned with internal policies and international standards.

Enabling Day 1 Operations for a Global Fintech Carve-Out
Within two and a half months, the company needed to establish standalone global operations, implement a new enterprise resource planning system, launch a new brand and stand up payroll and benefits functions worldwide, all while maintaining business continuity and minimizing disruption for employees and customers. FTI Consulting was engaged to provide strategic leadership and hands-on execution, embedding experienced operators across critical functions to build the standalone capabilities, systems and infrastructure needed for Day 1 operations.

Record-Breaking CAD3.56B Award Caps Decades of Litigation for Dow Chemical
In 1997, Union Carbide and NOVA Chemicals entered a joint venture to build a facility in Joffre, Alberta, Canada, with an 80-year contract to produce ethylene, a key ingredient for producing plastics. Dow Chemical, a competitor of NOVA, acquired Union Carbide’s ownership of the joint venture in 2001, expecting NOVA to honor the existing contract. However, in 2006, Dow sued, alleging that NOVA was diverting some of Dow’s ethylene for itself and was not running the plant at full capacity as they were required to do.FTI Consulting was engaged by Dow in 2011, and the case went to trial in 2015. In June 2018, the Court awarded CAD1.43 billion in damages covering the period from 2001 through 2012 and ordered an additional calculation for damages through June 2018. NOVA paid Dow in 2019.In September 2020, however, the Alberta Court of Appeal directed that Dow’s damages be recalculated, resulting in several years of court proceedings to determine the full amount of the damages award to Dow.

Identifying $42 Million in Cost-Saving Opportunities Amid Operating Model Redesign
A Latin America-based enterprise telecom provider wanted to redesign its organization and operating model. Turning to FTI Consulting for support, it was able to identify a number of meaningful cost-saving initiatives.

Exposing the Corruption that Helped Nigeria Defeat a $11 Billion Arbitral Claim
Nigeria’s economy risked ruin. At stake was an $11 billion arbitral award against the country that threatened to swallow nearly a third of its entire annual federal budget. But the gas agreement to build a processing facility at the centre of the claim was shrouded in suspicion of corruption. Nigeria’s lawyers — London dispute resolution heavyweights Mishcon de Reya — challenged the award in the courts. They turned to FTI Consulting, instructing our independent forensic accounting experts to assist with the detailed financial analysis and collection of documents. The multi-year investigation uncovered vital evidence that helped Nigeria overturn the arbitral award. Working together, lawyers at Mishcon de Reya and experts at FTI Consulting provided the evidence that helped expose dishonesty, concealed bribes and corruption, enabling justice to be done.

Managing Celsa’s Historic Restructuring
After 2009, the company’s cash generation profile changed dramatically, pushing Celsa into multiple restructuring agreements — first in 2013, and again in 2018. After 2018, most debt had been traded to special situations funds and other private credit investors. In September 2022, a change in restructuring law in Spain allowed Celsa’s creditors to present a restructuring plan unilaterally — the first of its kind in Spain — converting debt into equity and fully diluting the local family office. Celsa’s creditors engaged FTI Consulting to lead the company’s transition during the in-court restructuring plan’s implementation.

Helping a Spanish Manufacturer Respond to a National Government Investigation
FTI Consulting was appointed to carry out a due diligence exercise to help the client understand the facts of the matter and respond to the authorities. During this process, the company and its majority shareholding investment fund identified a series of potential irregularities across the business that could disrupt operations and impact compliance.
