Dr. Alok Khare is a Senior Managing Director based in San Francisco. He is an applied economist, econometrician and data scientist. Dr. Khare specializes in applying quantitative economic analysis, financial modeling, large data analytics and advanced statistical and econometric methods to complex litigation. Dr. Khare serves as both a testifying and consulting expert (often partnering with an academic affiliate as a testifier), providing rigorous economic, financial and data-driven analyses to evaluate economic analyses related to class certification, materiality, liability, loss causation and damages — including lost profits — in class actions and other high-stakes litigation. He has also been involved in business disputes, transfer-pricing-related tax controversies and numerous regulatory investigations, including those by the DOJ, SEC and FINRA.
Dr. Khare has substantial experience with economic analyses related to shareholder class actions and other types of securities litigation, market manipulation and white-collar defense matters. He has worked on more than 35 shareholder and other class actions and related litigations, in which he designed and performed hundreds of event studies and conducted analyses of market efficiency, price impact, economic materiality, loss causation, negative causation and damages in matters alleging violations of securities law in the United States, Australia and Canada. He has also analyzed the performance of trading strategies, assessed transaction costs and performed valuations of equities, fixed-income instruments and derivative securities. Dr. Khare has performed economic analyses in connection with alleged spoofing and market manipulation — including quantifying the temporary and permanent price impacts of excessive algorithmic and high-frequency trading — as well as insider trading and cherry-picking claims.
In class actions and competition economics matters, Dr. Khare has performed economic analyses related to both class certification and damages — including lost profits — in numerous class actions involving securities or antitrust violation allegations, product defect and product liability, false advertising, Telephone Consumer Protection Act (“TCPA”), consumer fraud, labor and employment, and excess or unauthorized fees. He has performed quantitative analyses to assess common impact, class-wide injury, class heterogeneity, typicality, predominance and the reliability of common damage models in class actions. In antitrust matters, he has worked on claims of price-fixing, monopolization and attempted monopolization, as well as exclusionary business practices such as market foreclosure and exclusive dealing.
Dr. Khare has defined and analyzed relevant product and geographic markets, assessed changes in market concentration using the Herfindahl-Hirschman Index (“HHI”) and other indices, estimated overcharges due to alleged price fixing, estimated the elasticity of demand, quantified loss of consumer surplus and assessed the impact on output and employment following the exclusion of certain products from relevant markets. Additionally, he has been retained as a testifying expert in intellectual property and copyright matters and has performed patent portfolio valuations and reasonable royalty estimations in bankruptcy proceedings.
In econometrics and statistical analyses, Dr. Khare has significant experience with sophisticated econometric models used in litigation, including time-series (ARCH/GARCH/VAR), panel-data, logistic and difference-in-differences models. He has designed and validated statistical sampling methodologies, assessed sampling error and confidence intervals, and analyzed the extrapolation of sample results to the population. Dr. Khare has also designed and conducted surveys to assess potential consumer confusion, evaluated conjoint analyses and discrete choice experiments and analyzed survey data using regression and other multivariate techniques in class actions and other litigations. Additionally, he has experience working on intellectual property and copyright matters. He testified on behalf of Shopify in a litigation alleging violations of the Digital Millennium Copyright Act (“DMCA”), opined on the effectiveness of Shopify’s copyright enforcement efforts and led the FTI Consulting team that supported Apple’s testifying expert in Phono IV proceedings before the Copyright Royalty Board. He has also performed patent portfolio valuations and reasonable royalty estimations in bankruptcy proceedings.
