About Xavier
Xavier Rayo is a Senior Director at FTI Consulting and an expert witness for the Construction Projects & Assets practice, at the heart of the Forensic and Litigation team based in Paris. Mr. Rayo is specialised in quantum assessments in the frame of arbitrations and dispute boards for large construction projects.
During the last 11 years, Mr. Rayo has specialised in quantum assessment as well as claim and contract management matters, mostly for large construction projects. He has been appointed as the quantum expert for two International Chamber of Commerce (‘ICC’) arbitration and appointed as a delay and quantum expert for an ICC Dispute Adjudication Board (‘DAB’) procedure.
Mr. Rayo has been involved in construction arbitrations under the rules of the ICC, Stockholm Chamber of Commerce (‘SCC’), the Arbitration and Mediation Centre in Santiago, as well as in DABs for the preparation of expert reports concerning the assessment of damages, prolongation costs, overhead and profits, interest and lost profit. Mr. Rayo has been recognized by the LEXOLOGY Index (formerly Who’s Who Legal) Arbitration Future Leaders – Expert Witness and Construction Expert Witness – Future Leaders lists.
Mr. Rayo has experience in the arbitral procedures of projects and industries including nuclear power plants, water treatment plants, hydroelectrical power plants, wind farms, mining, oil and gas facilities and infrastructure projects (roads and bridges). The amounts in dispute for the matters where he has intervened vary from a few million dollars to a large energy dispute where the difference of opinion achieved $7 billion dollars.
Mr. Rayo holds an M.A. in Economics and Business Administration and is legally trained, holding an LL.M. from Queen Mary University of London and specialising in Comparative and International Dispute Resolution. His article ‘Head Office Overhead & Profit’ was published in the CIArb Arbitration Journal, Vol. 88, Issue 3 (2022) and his article on ‘Interest claims, in the frame of Commercial and Investment Arbitral Procedures’ was published in the Construction Law Journal, Vol. 40 No. 3 (2024). Mr. Rayo has testified in Spanish and English, has full professional proficiency of French and has experience in construction projects in Europe, Africa and Latin America.
