Mark J. Malengo

Mark Malengo is a Senior Managing Director in FTI Consulting’s Forensic & Litigation Consulting segment and is based in Rockville, Maryland.

Mr. Malengo provides litigation support and consulting services related to the pricing of construction, government contracting, and other damages. These damages include breach of contract, requests for equitable adjustment, contract changes, and he has performed other types of cost analyses and investigative engagements. Mr. Malengo has worked on behalf of governmental agencies, private law firms, construction contractors, government contractors, corporations, and developers. Prior to joining FTI Consulting in February 2008, Mr. Malengo was a Shareholder for Rubino & McGeehin, a consulting firm located in Bethesda, Maryland.

Mr. Malengo has been engaged in the preparation, evaluation, and review of damage claims, as well as the review and analysis of change order proposals. Issues considered have included the analysis of costs and pricing methodologies, adequacy of cost accounting systems and underlying supporting documentation, and contract pricing terms. In addition, he has assisted with contract negotiations, interim and close-out contract audits, and contract compliance reviews.

Mr. Malengo has provided expert testimony, in deposition and trial proceedings, relating to accounting and damage issues before courts and boards, including the United States (U.S.) District Court, Circuit Court, Judicial Court of Oeiras (Lisbon, Portugal), U.S. Civilian Board of Contract Appeals, Maryland State Board of Contract Appeals, Commonwealth of Pennsylvania Board of Claims, as well as both domestic and international arbitration hearings. The public owners that Mr. Malengo has assisted include the U.S. Department of Justice, the U.S. Department of State, the District of Columbia, and the States of Maryland, North Carolina, Pennsylvania, South Carolina, and Virginia. Mr. Malengo has also provided consulting services for regional, national, and international contractors.

Mr. Malengo is a Certified Public Accountant and received a B.S. in Accounting from the University of Maryland.
