Henry Pannell

Henry Pannell is a Chartered Accountant and expert witness, specialising in the quantification of damages and business valuation in complex commercial and investor-state disputes. He has over 19 years’ experience in economic and financial analysis, accounting, and audit, advising clients across a wide range of industries and jurisdictions, with a particular focus on matters involving Sub-Saharan Africa and mining disputes.

Henry is regularly appointed as an expert witness in both arbitration and litigation, and has testified before arbitral tribunals. His work frequently involves advising on lost profits arising from breach of contract, valuation of shares, post-acquisition disputes, investor-state disputes, accounting issues, and the assessment of wasted costs.

He has been engaged on matters before the England and Wales courts, the Royal Court of Jersey, the High Court of South Africa, and all the major arbitration forums.

Henry also chairs FTI Consulting’s cross-segment Africa Working Group, reflecting his long-standing focus on Africa-related disputes. He has a keen interest in the application of AI in legal and expert-witness work, and is a member of FTI Consulting’s global AI committee.

Prior to working in disputes and economic consulting, Henry worked in the audit practice at EY London.

Relevant Experience:

• Assessed the loss suffered by a renewable energy company resulting from an alleged breach of contract by a Southern African state.
• Valued a minority shareholding in a Turkish retail company in the context of an alleged expropriation in an investor-state dispute.
• Valued a minority shareholding in an international fragrance company, in the context of an unfair prejudice claim.
• Assessed the value an investor’s shareholding in a mining company in the context of an alleged expropriation.
• Provided valuation advice to the minority shareholder of a mining company in the context of business rescue proceedings.
