During its execution phase, a major German rail wayside signalling project encountered delays, design uncertainties, unclear contract provisions and customer change requests, requiring a project restructuring to prepare for dispute negotiations. FTI Consulting was engaged to conduct a project assessment and position the project for effective dispute negotiations to secure a stronger foundation for future progress.
Our Impact
- By strengthening the organisational framework and documentation process, the client improved project oversight and achieved greater visibility into operational bottlenecks and the root causes of delays.
- The project underwent an operational restructuring, redefined its contract management strategy, increased key staffing and introduced industry-relevant processes to enhance delivery efficiency.
- The client greatly enhanced its claims preparedness posture and significantly improved its ability to navigate and defend against future delay and cost overrun claims in complex rail project environments.
- Our experts’ structural and content recommendations supported the client in preparing and submitting a comprehensive portfolio of substantiated claims to the end customer, establishing a stronger negotiating position to foster more balanced commercial discussions.
Our Role
- FTI Consulting performed an assessment of the troubled project, including finalising the design with the client, and conducted a comprehensive review across project management, contract management and risk analysis.
- Our experts systematically analysed the extensive amount of project documentation — including contracts, claims, financials and risk data — to gain a holistic understanding of the project status and issues.
- Leveraging our deep rail sector expertise, we identified critical improvement areas and delivered restructuring strategies, especially in contract management, to prepare for negotiations and potential dispute resolution.
