About Christopher
Christopher Cuthill is a civil engineer with experience in construction management, claims preparation and assessment and dispute resolution. With a background spanning multiple industries and countries, Mr. Cuthill brings a diverse understanding and perspective to his expert witness and alternative dispute resolution work.
Mr. Cuthill has led construction expert witness testimony in arbitrations and adjudications across Europe and Oceania. His expertise spans a range of projects, including linear and utility infrastructure, renewables, major buildings and rolling stock, with recent projects and program works valued between EUR150 million and NZD1.2 billion.
Mr. Cuthill began his dispute related works as an assessor of claims under his Engineer to the Contract roles in both NZS3910 and FIDIC Yellow Book. This led him to undertaking discrete claims and to lead alternative dispute resolution (“ADR”), including under the statutory adjudication regimes in Australasian jurisdictions. Since relocating to Germany, he has been involved in claims and arbitrations across Europe.
Relevant Experience:
- Project lead and expert assistant on an arbitration regarding delays for a citywide ticketing system overhaul in a major European city
- Successfully prepared claims and informed negotiations for a contractor for a European city light rail delivery, collaborating closely with the contractor to establish delay and quantum; this took the project from a net cost owed for delays to a net positive recovery
- Primary author and managed the contributions of lawyers, experts and the project team for statutory adjudication claims on a major highway
- Delay and disruption claims on a 460 megawatt solar farm project, pursuing these claims through to adjudication, while also planning and facilitating negotiated alternatives
- Conducted delay and quantum claim assessments for a robotic sorting device for cargo, including writing a FIDIC Engineer’s Determination, and provided expert advice to support the client's negotiating position
