About Kerry
Kerry Hinch is a Managing Director in FTI Consulting’s Forensic & Litigation segment and is based in Portland. Mr. Hinch uses his experience in accounting, auditing and finance to lead dispute consulting and forensic investigatory engagements. He helps explain complex financial issues to legal teams, audit committees and corporate executives in high-stakes lawsuits and accounting investigations, and is skilled at translating complex analytics and financial information into clear, easy-to-understand narratives and demonstratives.
Mr. Hinch has extensive experience in a variety of litigation consulting matters, including economic damages, forensic investigations and audit and accounting malpractice. This experience includes involvement in the resolution of various business, accounting, auditing or disclosure issues related to, among others, revenue recognition, whistleblower allegations, alleged fraud, management integrity and credibility, purchase accounting, governance, internal controls, alleged illegal acts, various types of contingencies and SEC and DOJ investigations.
Mr. Hinch has served clients in the industrial manufacturing, technology, software, forest products and financial services industries. His experience also encompasses complex technical accounting areas, including income taxes, revenue recognition, fair value measurement, derivatives and hedging, intangible assets and a variety of other significant and unusual transactions.
Mr. Hinch possesses an in-depth knowledge of U.S. Generally Accepted Accounting Principles (“GAAP”), Generally Accepted Auditing Standards (“GAAS”) and other standards and regulations issued by the American Institute of Certified Public Accountants (“AICPA”) and the SEC. He has assisted clients with public debt and equity offerings and complex debt and equity transactions. He also has extensive knowledge and practical experience identifying risks in global corporations and designing and implementing internal controls over financial reporting within organizations to mitigate risks and comply with regulatory requirements.
Mr. Hinch is a certified public accountant, certified in financial forensics and graduated from the University of Oregon, where he earned a B.S. and M.S. in accounting. Prior to joining FTI Consulting, he provided audit services at KPMG, where his experience included leading audit engagements for large accelerated filers.
Relevant Experience:
- Supported expert witness in a securities class action defense involving alleged inventory misstatements for an electric vehicle manufacturer
- Drafted expert report for defense in SEC revenue recognition case related to a software company acquisition; matter settled favorably
- Analyzed accounting and disclosure issues in a shareholder class action involving income taxes and transfer pricing for a global mining company
- Conducted valuation and technical accounting analyses in a dispute related to equity and debt instruments for a hospitality registrant
- Supported independent accountant in a post-acquisition inventory dispute in the energy sector
- Assisted a global technology distributor with an earnout dispute involving revenue, inventory, tax issues and accounting submissions
- Calculated damages in a semiconductor joint venture dispute; submitted multiple expert reports
- Evaluated audit compliance with AICPA and Public Company Accounting Oversight Board (“PCAOB”) standards for international accounting firms in professional sports and engineering sectors
- Provided expert analysis for disputes in real estate development, solar construction and pharmaceutical compounding
- Evaluated capitalized software for GAAP compliance for a major gaming operator and supported Big Four auditor discussions
- Drafted technical accounting papers on complex debt, revenue recognition and pro forma statements for offerings and SEC pre-clearance
- Investigated revenue recognition practices for a global manufacturing board; supported regulatory response efforts
- Conducted whistleblower-led internal investigations for multinational software and retail companies
- Led investigative support in misconduct reviews related to earnouts at an insurance brokerage and a fitness company registrant
