Expertise Enhances FTI Consulting’s Latin America Disputes Management Expertise
Mexico City, Feb. 8, 2023 — FTI Consulting, Inc. (NYSE: FCN) today announced that Orlando Pérez Gárate will serve as a Senior Advisor to the Latin America practice within the firm’s Strategic Communications segment.
Mr. Pérez Gárate, who is based in Mexico City, is an internationally recognized expert with 24 years of experience in international trade and investment issues. Most recently, he served as Lead Counsel of International Trade and Investment Arbitration for the government of Mexico, where he represented the country in international investment arbitration and state-to-state trade dispute negotiations at the World Trade Organization, and during the negotiations of the North American Free Trade Agreement, the U.S.-Mexico-Canada Agreement (“USMCA”) and various bi- and multilateral investment treaties.
In addition, Mr. Pérez Gárate was the lead negotiator of several chapters in the USMCA negotiations and the modernization of the free trade agreement between Mexico and the European Union, including on the issues of state-owned enterprises and intellectual property rights.
As a Senior Advisor at FTI Consulting, Mr. Pérez Gárate will work with the firm’s international arbitration and investment dispute advisory teams to develop multidimensional stakeholder management and communications programs for high-profile disputes across Latin America and enhance the firm’s multidisciplinary international dispute resolution offerings. He will collaborate with a multidisciplinary team of policy and public affairs professionals with expertise in disputes and cross-border issues management operating in Washington, D.C., Houston, Mexico City, Bogotá, and São Paulo.
“Orlando’s tenure as Mexico’s head of international arbitration, during a moment of unprecedented legal and regulatory upheaval in Mexico, gives him unique insight into the dynamics that impact investor-state disputes in every jurisdiction and the best way to pursue a potential resolution,” said Pablo Zárate, a Senior Managing Director and Mexico Lead for the Strategic Communications segment at FTI Consulting. “His appointment deepens our ability to provide creative, pragmatic counsel on cross-sector, business-critical disputes throughout Latin America.”
Ana Heeren, a Senior Managing Director and Head of the Latin America practice for the Strategic Communications segment at FTI Consulting, added, “As unorthodox policies are rolled out by various governments, disputes in Latin America are increasingly perceived as inevitable. But that should not mean that the preservation of business continuity, or even growth, is out of reach for companies that approach them holistically, while being mindful of stakeholder considerations. I look forward to working with Orlando to continue to advance these solutions for companies, investors and industries across the region.”
Commenting on the announcement, Mr. Pérez Gárate said, “There’s no question that a thoughtful, strategic management of stakeholder considerations throughout the different phases of a high-profile dispute – from pre-filing to post-ruling – preserves value for all parties involved. Quite often, it unlocks more constructive resolutions. I’m looking forward to working with FTI Consulting to help organizations identify and implement practical solutions.”
