Clayton Undercofler is a Managing Director at FTI Consulting and is based in Wayne, Pennsylvania. Mr. Undercofler is in the Environmental Solutions practice within the Forensic & Litigation Consulting segment.
For the past 30 years, Mr. Undercofler has provided neutral expert support related to environmental dispute resolution at more than 60 state and federal Superfund sites throughout the United States. His areas of expertise include alternative dispute resolution (“ADR”), cost allocation and potentially responsible party (“PRP”) investigation. In the last 15 years, Mr. Undercofler’s work has centered on Superfund “mega sites” that require the synthesis of factual, legal, technical and geospatial data into a comprehensive assessment that serves as the basis for settlement of client groups with federal and state agencies.
Mr. Undercofler specializes in the analysis and assessment of evidence — documentary, testimonial, technical and geospatial — and client advocacy. His experience encompasses a wide variety of sites, including contaminated sediment sites, landfills, used oil refineries, chemical processing plants, hazardous waste treatment plants and pesticide formulation facilities.
With experience in the management, design, execution and successful completion of multiparty ADR and cost allocation projects, Mr. Undercofler has advised clients on direction and management of multidisciplinary teams, as well as the design, collection, compilation, review and analysis of information and advocacy presented in confidential disclosures, questionnaires, regulatory agency information requests and position papers. In addition, he is experienced in private settlement facilitation and accompanying de minimis buyouts, outreach, facilitation, coordination and incorporation of state and federal agencies into private settlements.
Mr. Undercofler also focuses on the development of allocation models and recommendations, research and analysis of Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”) allocation case law and coordination of field investigations with knowledgeable parties.
