About Emily
Emily Cohen has approximately 20 years of experience in data privacy, regulatory compliance, forensic investigation and litigation consulting. Ms. Cohen focuses on privacy program advisory and investigations, as well as expert testimony related to tracking technologies.
In her previous role, Ms. Cohen led a global consulting firm’s tracking technology service offering, overseeing a team of privacy and cybersecurity professionals. She developed and scaled the offering into a flagship capability, in addition to supporting the development of other emerging service offerings such as the implementation of privacy technology to support core functions including risk assessments, automation of data subject request processes, data inventories and third-party risk management.
Ms. Cohen has been retained as an expert in pixel litigation matters and has managed more than 75 client engagements focused on technology litigation, investigations and proactive compliance initiatives. She has provided forensic data collection and expert advisory services to support high-stakes litigation. Additionally, Ms. Cohen has provided subject-matter expertise for compliance and framework audits, including the HIPAA Security Rule and NIST assessments.
Ms. Cohen previously worked in the Legal Technology Solutions practice at Navigant Consulting, where she directed large-scale data governance, structured data analytics and e-discovery initiatives and managed terabytes of complex financial and regulatory data across multiple jurisdictions. She began her career at Huron Consulting in the Financial & Economic Consulting group.
Ms. Cohen is a Certified Information Privacy Manager (“CIPM”) and holds a B.S. in finance from Miami University.
Relevant Experience:
- Provided expert witness services related to a healthcare provider matter involving the use of pixels and tracking technologies on a hospital’s websites; analyzed tracking technology configurations and related data along with opposing expert findings; testified on the tracking technology aspects of the matter; class was de-certified
- Performed a review of tracking technology deployment on websites for an organization that received a notice from the California Attorney General; established and executed a defensible approach to analyze the current state and developed recommendations for remediation
- Retained by a multinational telecommunications organization to assist with the identification of third-party data transfers in response to litigation related to the Video Privacy Protection Act (“VPPA”); led a team to perform a review of network packet transfers and HAR (HTTP Archive) file analysis to identify potential data transfers and associated third parties on current-state websites and mobile applications; reviewed client analytics and tag manager accounts to supplement analysis for historical and current-state analysis and prepared summary of findings to assist with risk and priority discussions with the client and counsel
- Led a team to identify current- and historical-state tracking technologies on a client’s websites; analyzed findings and provided recommendations for remediation and risk mitigation measures; prepared statement containing summary of findings for submission to the Office for Civil Rights (“OCR”)
- Led a team to identify current- and historical-state tracking technologies on a client’s websites, including session replay allegations as well as wiretapping claims; coordinated with various teams within the organization to gather information and present at varying levels of the organization
