Shelly Irvine is a Senior Managing Director in FTI Consulting's Dispute Advisory Services practice within the Forensic & Litigation Consulting segment. A recognized expert in intellectual property, Ms. Irvine advises clients and counsel involved in high-stakes disputes and those seeking to solve strategic issues related to their intellectual assets. Her clients include leading technology companies, innovators, investors and counsel involved in complex intellectual property litigation, licensing disputes and portfolio valuation matters. Her work spans patent, trademark, copyright and trade secret matters, as well as breach of contract and false advertising claims, among others.
With more than 25 years of experience, Ms. Irvine specializes in the quantification of economic damages stemming from claimed infringements, misappropriations, breach of contract and other economic harm. She has extensive experience evaluating patented technologies, assessing the contribution of patented technologies and other intellectual assets to commercial products and services, analyzing licensing agreements, assessing commercial success and applying damages methodologies consistent with evolving case law. Based in Silicon Valley, she is particularly focused on technology-driven and emerging growth industries, advising clients across the United States, Asia, the UK and Europe. As a Certified Licensing Professional (“CLP”), she brings both technical licensing expertise and practical business insight to complex intellectual property matters.
Ms. Irvine has worked with technology clients on business plans, benchmarking, best practices, IP valuation (for financing or to buy or sell IP) and commercialization/value extraction strategies through partnerships and joint ventures. Her combination of dispute consulting and real-world intellectual property practice provides a unique perspective that strengthens her expert testimony and advisory work, and she is a recognized thought leader in intellectual property damages and valuation. Prior to joining FTI Consulting, Ms. Irvine was a senior leader at Deloitte, advising clients on intellectual property disputes, damages assessments, valuation and licensing matters.
Ms. Irvine frequently speaks before organizations including the International Bar Association, the Licensing Executives Society and the California Society of Certified Public Accountants. She has lectured at the University of California, Berkeley, Stanford University and the University of California, San Francisco College of Law. Additionally, she served as faculty for the University College London’s biannual Conference on Patents and Standards, participating alongside leading judges, practitioners and academics in Washington, D.C., London and Tokyo. Her contributions to the field have been recognized by IAM Patent 1000, which noted her deep industry insight and command of patent damages jurisprudence. She is active in the Licensing Executives Society, the Sedona Conference, the Intellectual Property Owners Association Standards Committee and Chiefs in Intellectual Property (“ChIPs”) and has served on several nonprofit boards.
