FTI Consulting was engaged by outside counsel for one of the largest U.S. health insurers to support its defense in a high-stakes civil lawsuit filed by a PE-backed employer of ER doctors challenging reimbursement reductions. With jury selection imminent and a previous similar case resulting in a costly verdict, counsel needed rapid, in-depth research on prospective jurors to identify potential biases and guide strategic voir dire decisions. Following the departure of the client’s jury consultant in advance of the trial, FTI Consulting performed targeted open-source intelligence under a tight timeline, enabling counsel to make informed jury challenges and ultimately secure a favorable outcome at trial.
Our Impact
- Counsel received actionable insights on 82 prospective jurors in just 72 hours, including comprehensive research and analytical memos on juror backgrounds, social media activity and potential biases.
- Insights from our assessment enabled counsel to exercise strategic challenges that improved the overall composition of the empaneled jury.
- Beyond juror research, counsel received an analysis of credentials and track records of five physicians scheduled to testify on behalf of the plaintiffs that identified several discrepancies in their reported qualifications and undermined credibility.
- The jury returned a verdict in favor of the client, protecting financial and reputational interests and setting a positive precedent for similar litigation.
Our Role
- FTI Consulting conducted detailed research across social media, public records and civil and criminal filings to uncover juror attitudes and potential biases.
- The team cross-referenced juror questionnaires with independent research to provide accurate and nuanced assessments of each juror’s disposition toward the client and the broader health insurance industry.
- Our experts prepared high-quality, actionable memos and headline assessments under a compressed timeline and provided guidance and recommendations throughout the jury selection process to ensure counsel could make informed, evidence-based decisions.
