The U.S. based counsel of a global railway track maintenance company was conducting an anti-bribery and anti-corruption investigation into whistleblower allegations of fraud and corruption against the company’s Indian leadership team and third-party vendors. The counsel engaged FTI Consulting to aid in the investigation.
Our Impact:
- Based on the investigation findings, the client terminated the employment of the involved employees and discontinued its relationship with the concerned vendors.
- The client self-disclosed the violations of the Foreign Corrupt Practices Act (“FCPA”) to the U.S. Department of Justice.
- FTI Consulting quantified the potential loss from stolen funds to support the client’s insurance claims.
- The client’s corporate compliance program was strengthened due to FTI Consulting’s identification of critical corporate governance and control gaps and ultimate recommendations.
Our Role:
- FTI Consulting conducted extensive public domain searches and discreet inquiries, revealing common directorship between subject vendors, potential schemes for funneling kickbacks to employees and red flags related to the lifestyle of the involved employees.
- FTI Consulting assisted the counsel in reviewing the electronically stored information (“ESI”) pertaining to more than 13 custodians and performed forensic collections of over 15 devices.
- Through ESI review and transaction testing, FTI Consulting identified indicators of payment of bribes and kickbacks to government officials, as well as severe deficiencies in the internal control environment.
- FTI Consulting supported the counsel in conducting information gathering interviews with employees, suppliers and the whistleblowers, which led to gathering additional evidence and revealed other misconduct by the India leadership team and certain vendors.
- FTI Consulting advised the client on how to respond to the Statutory and Internal Auditors, and relevant regulatory and third-party reporting.
