Steven S. McNew is a Senior Managing Director within the Technology practice of FTI Consulting and is based in Houston. In his role, Mr. McNew advises clients on cost-effective and defensible strategies to manage data for complex legal and regulatory matters. Mr. McNew is an expert in information security, information management, data security, complex discovery, and digital forensics.

Prior to joining FTI Consulting, Mr. McNew held leadership positions with several legal and information governance consulting firms, including Navigant Consulting and Huron Consulting Group. For 31 years, he has applied this expertise by leading thousands of engagements for corporate and law firm clients globally, across numerous industries, including financial services, healthcare, oil and gas, utilities, telecommunications, governmental agencies, defense, entertainment and hospitality. In addition to reactive work with regard to incident response, litigation, and investigations, Mr. McNew leads proactive advisory consulting related to information security, all phases of the EDRM, predictive coding/Technology Assisted Review, complex data analysis, and information lifecycle management.

Mr. McNew has served as strategic advisor, consultant, engagement manager, and project manager to corporations of all sizes and their legal counsel in a multitude of matters. Some representative matters include:

  • For an international financial institution, led e-discovery for dozens of regulatory and litigation matters arising from positions in mortgaged-backed securities. This included identification and collection of more than 60 TB of archived data from 150 custodians; processing and searching of roughly 15 TB’s of collected data; hosting and production activities; and coordinating activities between the corporate client, two services providers and four top-ranking national and international law firms.
  • Provided extensive forensic collection, analysis, reporting, and advisory services related to potential spoliation claims arising from a litigation involving a commodities investments organization. When faced with the potential loss of relevant data due to possible, inadvertent destruction, Mr. McNew was engaged by outside counsel and the company to conduct an analysis of hundreds of previously collected evidence items, previously produced records and the company’s current data store to build a potential gap analysis. Efforts enabled counsel to defend previous preservation efforts and draw relevant data from previous collections.
  • Provided strategic consulting, e-discovery, information management and technology services to the world’s largest research-based pharmaceutical company for more than six years with matters involving contract disputes, multiple drug cases, and general litigation.

Mr. McNew regularly presents at industry events on best practices for e-discovery, data security and information governance.
